Injured worker filling out paperwork

Workers’ compensation in Illinois can become complicated if you don’t have comprehensive experience dealing with these sorts of matters. For the best chances of success with an Illinois workers’ compensation claim, it is wise to hire an attorney that is highly skilled in this area of the law.

Frequently Asked Questions

  • Does my employer have workers’ compensation coverage?

    • Illinois state law requires employers to post a finalized workers’ compensation notice in a prominent area of your worksite. Knowing this information is within your rights.

  • What do I do if my employer doesn’t have workers’ compensation insurance?

    • If you’re unsure whether your employer has workers’ compensation insurance, you can search the Illinois State government online insurance database, email their Insurance Compliance Division, or call their Information Unit at (312) 814-6611 or toll-free within Illinois at (866) 352-3033. They will do their best to establish your employer’s insurance carrier. If they’re unable to locate one, they will reach out to the employer for proof of insurance. • Does my group health plan or occupational disability insurance cover workers’ compensation claims?

    • No. The following plans will not cover workers’ compensation claims: group health, occupational disability, general liability, disability, and property insurance. The only plans that covers these claims are workers’ compensation policies. This type of coverage is only permissible through carriers who are authorized in the state of Illinois to write workers’ compensation insurance.

The State of Illinois Workers’ Compensation Commission provides a useful insurance compliance brochure to help employees understand their rights.
